By accessing or using Ghostly Host services (operated by GHOSTLY HOST LLC), including ghostly.gg and ghostly.host, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws. If you do not agree, you must not use our services.
Eligibility and Accounts
You must be at least 13 years old (or the minimum age of majority in your jurisdiction) to use our services. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.
User Responsibilities & Prohibited Conduct
You agree not to: • Use our services for any illegal purpose or in violation of any applicable laws, including any game’s End User License Agreement (EULA), Terms of Service, or other usage rules. • Engage in cheating, exploits, DDoS attacks, botting, or any form of abuse that disrupts service for others. • Upload, store, or distribute content that is infringing, defamatory, obscene, or harmful. • Attempt to gain unauthorized access to our systems or other users' servers. • Overuse resources beyond your plan limits or attempt to circumvent fair-use policies. • Resell, sublicense, or commercially exploit our services without our written permission. Violation of these rules may result in immediate suspension or termination without refund.
Server Content & Backups
You retain ownership of all data and content you upload to your servers. However, you grant GHOSTLY HOST LLC a worldwide, royalty-free license to host, store, copy, and transmit your content as necessary to provide the service. We are not responsible for any loss of data. You are solely responsible for maintaining your own backups. We may offer automated backups as a convenience, but they are not guaranteed.
Payments and Billing
All payments are non-refundable except where required by law. Subscriptions automatically renew unless cancelled before the renewal date. We may suspend or terminate your service for any unpaid balances. Late payments may incur reactivation fees.
Promotions, Free Services, and Credits
From time to time, we may offer promotions, free servers, credits, giveaways, or other incentives (including through partners or special events). These offers are provided at our sole discretion and are not guaranteed. We reserve the right to modify, suspend, cancel, or terminate any promotion, free service, credit, or related benefit at any time, with or without notice, for any reason, including but not limited to abuse, technical issues, or changes in business needs. Because no payment is received for these items, you are not entitled to any refund, compensation, or continued access if they are altered or removed.
Intellectual Property
All trademarks, logos, and service marks displayed on Ghostly Host (including but not limited to Ghostly, Ghostly Host, Ghostly Hosting, ghostly.gg, and ghostly.gg) are the property of GHOSTLY HOST LLC or their respective owners. Game icons, images, backgrounds, names, logos, and other assets (Minecraft, and all other supported games) are the property of their respective copyright and trademark holders (such as Mojang Studios and other game publishers). We do not claim any ownership over these third-party assets. These assets are used solely for informational, identification, and promotional purposes. We use them in good faith under fair use principles or with implied permission to help users identify the games we support. If you are a rights holder and believe any content should be removed, please contact us.
Termination and Suspension
We may suspend or terminate your account or access to any service at any time, with or without notice, for any reason, including violation of these Terms. You may cancel your subscription at any time via your account dashboard. Upon termination, you are not entitled to any refunds unless otherwise stated in our policies.
Disclaimers and Limitation of Liability
Our services are provided 'AS IS' and 'AS AVAILABLE' without any warranties, express or implied. We do not guarantee uptime, performance, or that the service will be error-free. To the fullest extent permitted by law, GHOSTLY HOST LLC and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless GHOSTLY HOST LLC, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of your use of the service, your content, or your violation of these Terms.
Changes to Terms
We may update these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the 'Last Updated' date. Your continued use of the service after such changes constitutes your acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, USA, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Anderson County, Kentucky.
